2026-05-13 - “The draft law is fundamentally a move in the right direction. It reduces rigid specifications for heating systems and implements European requirements without additional national tightening. This provides impetus for better aligning climate protection goals, cost-efficiency, and acceptance in the building sector. Positively, it offers companies more options on their path to climate neutrality in the building sector.
At the same time, significant uncertainties persist. Core questions regarding the design of the so-called bio-pyramid, the availability, cost-effectiveness, and efficiency of climate-friendly fuels, as well as the development pathway beyond the year 2040, remain unresolved. Furthermore, there is a lack of clarity in crucial practical matters, such as the cost distribution between tenants and landlords, proof obligations, billing systems, or the impact on condominium associations. Reliable and transparent framework conditions for the expansion of district heating are also still missing.
For the vast majority of businesses, implementation will remain a significant economic challenge. A comprehensive consultation could have helped identify and resolve uncertainties at an early stage. However, the extremely short timeframe for comments once again does not do justice to the complexity and economic significance of the law.”
