Data Act: Next level as of 12 September 2026

"Access by design" becomes mandatory – users gain immediate access to device data

The EU aims to simplify access to data from connected products through the Data Act. Starting September 2026, access to data will become a basic technical requirement.

With the EU Data Act (Regulation (EU) 2023/2854), the European Union establishes another milestone in its data strategy. The regulation governs how data from connected products and services can be used – and aims to significantly ease access for users. All devices connected to the Internet and generating data are affected, such as smart home appliances, wearables, vehicles, production machines, or agricultural vehicles.

Since September 2025, manufacturers and providers of digital services have been required to ensure that users can view data generated during usage and, if desired, share it with third parties. This enables new services and more competition.

On 12 September 2026, the next level follows: For all new products and services, the principle of "access by design" applies. This means that devices must be designed to make generated data directly and automatically available – without complicated requests or additional software. Users should be able to view and process the data immediately via the device or corresponding application.

For companies, this means they must technically adapt their products, create interfaces, and implement clear processes for data access. At the same time, new opportunities for data-driven business models open up – such as maintenance or analysis services. Acting early can secure competitive advantages. However, violations of the requirements may result in sanctions, as the Data Act as an EU regulation applies directly.
